1. Information about the data processing

RIDASOFTWIN allows you to test food for mycotoxin concentrations and manage the results.

When using the software, we process personal data about you. Personal data means any information relating to an identified or identifiable natural person. Protecting your privacy is important to R-Biopharm, so we would like to use the following information to inform you about what personal data we process when you use RIDASOFTWIN.

As part of your use of the Software, we automatically collect certain information that is necessary for the use of the Software. This includes: The IP address of the requesting device, the date & time of access. During the execution of the selected test, the GPS location is also collected so that we can offer you region-dependent forecast functions (e.g. conspicuously high number of food contaminations i.V.m. precipitation amounts).

Furthermore, the following information is collected in anonymized form, i.e. without personal reference: Operating system, device number, software version RIDASOFTWIN, license number, time stamp, number of measurements performed, test types & applications used, information on measurement results and whether the results were exported or printed.

This data is automatically transmitted to us and temporarily stored for a period of 5 years. The longer storage period results from the forecast functions offered.

This data is collected and processed for the purpose of enabling the use of RIDASOFTWIN (connection establishment), to ensure system security and stability on a permanent basis, to enable the technical administration of the network infrastructure and the optimization of RIDASOFTWIN, as well as for internal statistical purposes. The IP address is only evaluated in the event of attacks on our network infrastructure, as well as for statistical purposes. This data processing is justified by the fact that the processing is necessary for the fulfillment of the contract between you as the data subject and R-Biopharm as the provider, pursuant to Art. 6 (1) lit. b) GDPR, for the use of the software or we have a legitimate interest within the meaning of Art. 6 (1) lit. f) GDPR in being able to ensure the functionality and error-free operation of the software.

4. Creation of an user account (registration) and login

In order to use RIDASOFTWIN, you must first register and create an user account. During the registration process, the following data will be collected from you: First & last name, company name, country as well as your e-mail address. You will also be required to enter a password for your future user account. Optionally, you can also provide the following information: Phone number, position in the company, as well as the city where your company is located.

In order to finally activate RIDASOFTWIN on your device, you must confirm your e-mail address in the e-mail we send you after registration. This confirmation is required by us in the sense of a multi-stage authentication process in order to verify the authenticity of your data and to prevent potential misuse.

Furthermore, we use the data provided above to authenticate you when you log in and to follow up on requests to reset your password. Your information will also be used to verify your authorization to manage the user account, to enforce the terms of use of the software and all related rights and obligations, and to contact you to send you technical or legal notices, updates, security messages, or other communications relating to, for example, the management of the user account.

You can delete your data or your entire user profile at any time. This can be done by using the corresponding option in your user profile.

The data processing is carried out to fulfill the contract concluded with you pursuant to Art. 6 para. 1 lit. b) GDPR, as well as to ensure the functionality and error-free operation of the app based on our legitimate interest pursuant to Art. 6 para. 1 lit. f) GDPR.

5. Data transfer

If you provide us with personal data, this will only be passed on to third parties if this is necessary to process the contractual relationship or if another legal reason legitimizes the transfer. However, we provide certain services with the assistance of service providers. We have carefully selected these service providers and taken appropriate measures to protect your personal data.

For the provision of the software, we use the following service providers, which may have access to your personal data:

If a service provider is located outside the European Union, or the European Economic Area, a third country transfer takes place. RIDASOFTWIN uses cookies. Cookies are small text files that are stored in the memory of your terminal device and assigned to the software you are using. Cookies allow R-Biopharm to obtain certain information, such as the browser you are using. Cookies cannot execute programs or transfer viruses to your end device. They are used to make the software more user-friendly and effective overall.

RIDASOFTWIN uses the following types of cookies, the scope and functionality of which are explained below:

Transient cookies are automatically deleted when you close our software. These include, in particular, session cookies. These store a so-called session ID, which can be used to assign various requests to your software. This allows your end device to be recognized when you use our software again. Session cookies are deleted when you log out or close the software.

Persistent cookies are deleted automatically after a specified duration, which may differ depending on the cookie. You can refuse to accept third-party cookies or all cookies. Please note that you may not be able to use all the features of our software.

The legal basis for data processing using cookies is your consent in accordance with Art. 6 (1) a) GDPR.

7. Security

R-Biopharm uses appropriate technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or against unauthorized third-party access. Our security measures are continuously improved in line with technological developments.

8. Storage duration and deletion of data

The personal data collected or recorded by R-Biopharm for the performance of the contract will be stored until the expiry of the legal obligation to keep records and then deleted, unless R-Biopharm is obliged to store the data for a longer period of time pursuant to Article 6 para. 1 lit. c) GDPR, R-Biopharm is obliged to store the data for a longer period of time due to tax and commercial law retention and documentation obligations (from HGB, StGB or AO), there is an overriding legitimate interest on the part of R-Biopharm according to Art. 6 para. 1 lit. f) GDPR or the customer has consented to storage beyond this according to Art. 6 para. 1 lit. a) GDPR.
